Octopus are highly intelligent creatures.not that ANY creature should suffer like this. PETA is arguing that this practice violates New York's anti-cruelty laws. In March, Gutierrez changed his story and agreed to “cooperate with prosecutors,” so his 15 counts of animal cruelty were dropped to one. What about people who are kind and decent and obey the law? Who suffers for these crimes? The innocent birds and the decent, law-abiding people who cared for them.

Whereas it once used to be argued, as by Newman , that the least human good compensates for any possible amount of animal suffering, the current doctrine is that it requires a considerable good to compensate for such suffering. Man-hunting is ruled out as a sport but not, at least with the same degree of unanimity, fox or bird hunting.
