Because Midway is home to endangered species ( e.g. , Laysan Duck, Hawaiian Monk Seal), FWS must also comply with the Endangered Species Act (ESA). Midway’s birds are also protected by the Migratory Bird Treaty Act. This will focus on the requirements of NEPA.

The animal protection group Seal Sitters says a necropsy showed that the sea lion had suffered a shark bite and had twisted intestines in addition to a bullet wound. KING says one of the Nisqually casualties was a Steller sea lion, protected under the Endangered Species Act. Investigators say they do not know who is responsible.

It was chosen as the national bird by dint of its inclusion in the National Seal of the United States, which happened by an act of the Continental Congress on 20 June 1782. The banning of DDT and subsequent management of the species led to Bald Eagles being the poster child for the success of the Endangered Species Act.

In the early morning out on the water there were plenty of Fluttering Shearwaters and Australasian Gannets, and close to a salmon farm we found New Zealand Fur Seals as well as Pied Shags, Little Shags and Spotted Shags (I can only assume that kiwis just like calling all cormorants shags because they are all five years old).

Their numbers have declined so rapidly that a paltry 10 percent of the pre-20th century population remains (read Adam Riley’s post on Africa’s endangered species ). Sharks, Cape Fur Seals and even Killer Whales will prey on them in the ocean.
