Supreme Court to Review Legality of Animal Abuse Videos

The appeals court said the goal of protecting against animal cruelty was a worthy one, but one already accomplished by laws in all 50 states and the District of Columbia outlawing the practice. The appeals court noted that the Supreme Court is resistant to removing First Amendment protections of depictions even of illegal actions. You'd think it would be a no-brainer, but no.

Appeal Denied for Six Activists Convicted Under AEPA

Six members of Stop Huntingdon Animal Cruelty were convicted at a 2006 trial in New Jersey of conspiracy to violate the 1992 Animal Enterprise Protection Act. The law, since revised, aimed to protect animal research laboratories from illegal, sometimes violent protests. The company had been a target of animal activists since video footage surfaced on television in the 1990s depicting animal abuse at its laboratory in the United Kingdom.

The statute defines a depiction of animal cruelty as “any visual or auditory depiction, including any photograph, motion-picture film, video recording, electronic image, or sound recording of conduct in which a living animal is intentionally maimed, mutilated, tortured, wounded, or killed, if such conduct is illegal.” The law also made it a crime to sell videos in which animals were tortured to death by being burned alive, as well as videos of illegal dog fights.

He was jailed along with six other activists for violating the Animal Enterprise Protection Act. He is believed to be the first prisoner released from a CMU.

Here's my question: What about, say, videos taken inside slaughterhouses? When is violence toward an animal in a video gratuitous? And finally, who is to decide when a video is entertaining versus informative?

Supreme Court Strikes Down Depiction of Animal Cruelty Act

The high court case stemmed from the arrest and conviction of a Virginia-based documentary producer named Robert Stevens who sold videos containing scenes of dogfights. Mr. Stevens said his videos were aimed at portraying the aggressive characteristics of pit bulls and the use of pit bulls in hunting. He argued that his documentaries were protected by the First Amendment. The Supreme Court struck down a law that outlawed the depiction of animal cruelty.

6): I do not agree that “anyone with an appreciation for the First Amendment” must conclude that “crush videos” or videos of vicious dogfights are protected speech and that the federal law in question should therefore be struck down. The law speaks specifically and narrowly to the distribution for profit of videos that show illegal acts of cruelty actually being performed on live animals (my italics). Why are “crush videos” involving animals any different?
